Sex Discrimination in Sentence Remission in Scotland

Under a penal law enacted in Scotland in October, 1853, a male convict could obtain remission of up to one-fourth of his sentence. Under that law, a female convict could obtain remission of up to one-third of her sentence.^ The rationale for this sex discrimination isn’t clear. From about 1850 to 1870, about twice as many Scottish males compared to females were in prison.
