The European Community Treaty requires eliminating gender inequality. Under Article 2 of the Treaty, one of the tasks of the European Community is to promote “equality between men and women.” Article 3 requires the Community to “eliminate inequalities, and to promote equality, between men and women.”

Notwithstanding those formal requirements, gender inequality in punishment in Europe is now greater than gender inequality in punishment in Europe three centuries ago.
